1. INTRODUCTION
Welcome to Harveys Woodworx ("Harveys Woodworx", "we", "our", or "us").
These Terms of Service ("Terms") govern your access to and use of the Harveys Woodworx website, including all products, services, information, digital content, quotations, communications, and purchases made through our website.
By accessing, browsing, using, or placing an order through our website, you confirm that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree to these Terms, you must discontinue use of the website immediately.
These Terms should be read together with our:
- Privacy Policy
- Refund & Returns Policy
- Shipping & Delivery Policy
where applicable.
Nothing contained within these Terms limits or removes any rights afforded to consumers under applicable South African law.
2. DEFINITIONS
For purposes of these Terms:
Business Day means any day other than a Saturday, Sunday or South African public holiday.
Consumer has the meaning assigned under the Consumer Protection Act 68 of 2008.
Custom Product means any product manufactured, engraved, designed or modified specifically according to a customer's requirements.
Goods means all products sold by Harveys Woodworx.
Order means a request submitted by a customer to purchase Goods from Harveys Woodworx.
Services means all services provided by Harveys Woodworx including custom woodworking, product manufacturing, quotations, consultations and related services.
Website means the Harveys Woodworx online store together with all associated webpages.
3. ACCEPTANCE OF TERMS
By using this Website you confirm that:
- you are at least 18 years of age or are using the Website under the supervision of a parent or legal guardian;
- you have the legal capacity to enter into binding agreements;
- all information supplied by you is true, complete and accurate;
- you will use this Website only for lawful purposes.
You may not use this Website if doing so would violate any applicable law.
4. ABOUT HARVEYS WOODWORX
Harveys Woodworx is a South African woodworking business specialising in handcrafted timber products including, but not limited to:
- End-grain cutting boards
- Edge-grain cutting boards
- Serving boards
- Charcuterie boards
- Home décor
- Shelving
- Furniture
- Custom woodworking projects
- Timber accessories
Many of our products are individually handcrafted.
Accordingly, each product is unique and no two items will be identical.
5. USE OF THIS WEBSITE
You agree to use this Website responsibly and only for legitimate purposes.
You may not:
- use the Website for fraudulent purposes;
- interfere with the operation or security of the Website;
- attempt to gain unauthorised access to any part of the Website;
- upload malicious software, viruses or harmful code;
- impersonate another individual or business;
- provide false information when placing an order;
- copy, reproduce or exploit any part of the Website without our written permission.
We reserve the right to suspend or terminate access where misuse is suspected.
6. PRODUCTS
Harveys Woodworx strives to ensure that all product descriptions, specifications and photographs are accurate.
However:
- colours displayed on different screens may vary;
- timber naturally varies in grain, texture and colour;
- dimensions may vary slightly due to handcrafted manufacturing;
- finished products may differ slightly from photographs.
Such differences do not constitute defects.
Because every piece of timber is naturally unique, no two handcrafted products will ever be identical.
Customers acknowledge and accept these natural variations when placing an order.
7. HANDCRAFTED TIMBER DISCLAIMER
All products manufactured by Harveys Woodworx are handcrafted using natural timber.
Natural timber contains characteristics including but not limited to:
- grain variation;
- knots;
- mineral streaks;
- colour differences;
- texture variation;
- natural figure;
- seasonal movement.
These characteristics are not faults.
They are considered part of the natural beauty of solid wood.
No claim for replacement, refund or exchange will arise solely because the grain pattern, colour or appearance differs from photographs displayed on the Website.
8. WOOD MOVEMENT
Wood is a natural material that expands and contracts with changes in humidity and temperature.
Although Harveys Woodworx carefully selects, dries and prepares timber before manufacturing, seasonal movement may still occur.
This may include:
- slight expansion;
- slight contraction;
- small surface checks;
- minor changes in colour over time.
These are natural characteristics of timber and are not manufacturing defects.
Customers are responsible for maintaining products in accordance with the Product Care Guide supplied by Harveys Woodworx.
Damage resulting from improper care, prolonged exposure to moisture, excessive heat, direct sunlight or misuse is not covered under any warranty except where required by South African law.
9. FOOD SAFE PRODUCTS
Where a cutting board or serving board is advertised as food safe, it has been finished using finishes considered suitable for food-contact surfaces when fully cured.
Customers remain responsible for:
- cleaning products correctly;
- regularly oiling timber products;
- avoiding prolonged soaking in water;
- avoiding dishwashers;
- avoiding microwave ovens;
- avoiding exposure to excessive heat.
Failure to follow recommended care instructions may significantly shorten the lifespan of the product and may void any voluntary warranty offered by Harveys Woodworx.
Nothing in this clause limits any statutory rights under the Consumer Protection Act.
10. PRODUCT AVAILABILITY
Products displayed on the Website are subject to availability.
Harveys Woodworx reserves the right to:
- discontinue products;
- modify product specifications;
- substitute timber species where appropriate after consultation with the customer;
- limit quantities;
- refuse orders where stock is unavailable.
Should an item become unavailable after an order has been placed, Harveys Woodworx will contact the customer to discuss:
- an alternative product;
- revised manufacturing time;
- or a refund where appropriate.
11. PRICING
All prices displayed on the Website are quoted in South African Rand (ZAR).
Harveys Woodworx is not currently registered as a VAT vendor, and accordingly VAT is not charged on our products or services.
Prices are subject to change without prior notice.
However, once an order has been accepted by Harveys Woodworx, the agreed purchase price will not be changed unless:
- the customer requests alterations;
- pricing errors occurred;
- custom specifications change before production begins.
Obvious pricing errors may be corrected before acceptance of an order.
12. QUOTATIONS
12.1 All quotations issued by Harveys Woodworx are provided in good faith and are based on the information supplied by the customer at the time of quotation.
12.2 Unless otherwise stated in writing, quotations remain valid for 30 (thirty) calendar days from the date of issue.
12.3 A quotation does not constitute a binding agreement until accepted by both the customer and Harveys Woodworx.
12.4 If the customer requests changes to the specifications, dimensions, materials, finish, engraving, hardware or any other aspect of the quoted work, Harveys Woodworx reserves the right to amend the quotation accordingly.
12.5 Prices may be revised where the cost of timber, hardware, consumables or shipping changes significantly before an order has been accepted.
12.6 Any drawings, sketches, designs or concepts supplied as part of a quotation remain the intellectual property of Harveys Woodworx unless otherwise agreed in writing.
13. PLACING AN ORDER
13.1 By placing an order through our Website, email, telephone or any other communication channel, you are making an offer to purchase the selected Goods.
13.2 Harveys Woodworx reserves the right to accept or decline any order at its sole discretion.
13.3 An order is only accepted once:
- payment or the required deposit has been received (where applicable);
- stock or materials have been confirmed;
- Harveys Woodworx confirms acceptance of the order.
13.4 Harveys Woodworx may refuse an order where:
- product information supplied by the customer is incomplete or inaccurate;
- payment cannot be verified;
- the requested product cannot reasonably be manufactured;
- materials are unavailable;
- fraudulent activity is suspected.
13.5 If an order cannot be accepted after payment has been received, any monies paid will be refunded within a reasonable period using the original payment method unless otherwise agreed.
14. CUSTOM ORDERS
14.1 Harveys Woodworx specialises in handcrafted custom woodworking products.
14.2 Custom products are manufactured according to customer specifications and may include:
- custom dimensions;
- personalised engraving;
- specific timber selections;
- custom finishes;
- unique designs.
14.3 Customers are responsible for ensuring that all measurements, spelling, artwork, specifications and instructions supplied are accurate before production begins.
14.4 Harveys Woodworx will not be responsible for errors resulting from incorrect information supplied by the customer.
14.5 Once production has commenced, changes may no longer be possible.
14.6 Where changes are possible after production has commenced, additional charges and revised lead times may apply.
14.7 Due to the bespoke nature of custom products, completed custom orders may not be cancelled or returned solely because the customer changes their mind, except where required under applicable South African law.
15. DEPOSITS
15.1 Harveys Woodworx may require a deposit before manufacturing begins.
15.2 The deposit amount will be communicated to the customer before acceptance of the order.
15.3 Deposits are used to purchase timber, hardware, finishes and other materials required specifically for the customer's order.
15.4 If the customer cancels an accepted custom order after materials have been purchased or production has commenced, Harveys Woodworx may retain all or part of the deposit to cover costs already incurred, subject always to the Consumer Protection Act.
15.5 Where Harveys Woodworx is unable to complete the order for reasons within our control, any unused portion of the deposit will be refunded.
16. PAYMENTS
16.1 Payment may be made using payment methods offered through the Website or by other methods agreed between Harveys Woodworx and the customer.
16.2 Full payment may be required before dispatch or collection unless alternative arrangements have been agreed in writing.
16.3 Harveys Woodworx reserves the right to withhold delivery or collection of Goods until payment has been received in full.
16.4 Ownership of the Goods remains with Harveys Woodworx until payment has been received in full.
16.5 Customers are responsible for ensuring that payment details supplied are accurate.
17. MANUFACTURING LEAD TIMES
17.1 Estimated manufacturing times displayed on the Website or communicated to customers are estimates only.
17.2 Typical lead times for handcrafted products range from 3 to 7 business days, although larger or custom projects may require additional time.
17.3 Lead times may vary due to:
- workload;
- timber availability;
- supplier delays;
- custom specifications;
- weather conditions;
- public holidays;
- unforeseen manufacturing requirements.
17.4 Harveys Woodworx will make reasonable efforts to keep customers informed of significant delays.
17.5 Delays caused by circumstances beyond our reasonable control do not entitle the customer to claim damages, except where otherwise required by law.
18. SHIPPING AND DELIVERY
18.1 Harveys Woodworx delivers within South Africa using reputable courier services or other agreed delivery methods.
18.2 Delivery costs will be displayed during checkout or communicated before the order is confirmed.
18.3 Delivery timeframes are estimates only and are not guaranteed.
18.4 Harveys Woodworx is not responsible for delays caused by:
- courier companies;
- adverse weather;
- strikes;
- civil unrest;
- incorrect delivery information supplied by the customer;
- events beyond our reasonable control.
18.5 Customers must inspect delivered Goods as soon as reasonably possible and notify Harveys Woodworx of any apparent transport damage within 48 hours of delivery.
18.6 Failure to notify Harveys Woodworx within a reasonable time may affect our ability to investigate claims against the courier.
19. COLLECTION OF GOODS
19.1 Where collection has been agreed, Harveys Woodworx will notify the customer when the Goods are ready.
19.2 Customers must collect their Goods within a reasonable time after notification unless other arrangements have been agreed.
19.3 Harveys Woodworx reserves the right to charge reasonable storage costs for Goods not collected within 30 days after notification at a rate communicated to the customer.
19.4 Customers or their authorised representatives may be required to provide proof of identity before collection.
20. RISK AND OWNERSHIP
20.1 Ownership of Goods remains with Harveys Woodworx until payment has been received in full.
20.2 Risk in the Goods passes to the customer:
- upon delivery to the address specified by the customer; or
- upon collection by the customer or the customer's authorised representative,
whichever occurs first.
20.3 Customers are responsible for ensuring that the delivery address supplied is accurate and accessible.
20.4 Harveys Woodworx is not responsible for loss or damage occurring after risk has passed to the customer, except where required by law.
21. CANCELLATIONS
21.1 Customers may request cancellation of an order before production has commenced.
21.2 Cancellation requests must be submitted as soon as possible by email or telephone.
21.3 If production has not commenced, Harveys Woodworx may approve the cancellation and refund any amounts paid, less any reasonable costs already incurred. Customers will be provided with a breakdown of any costs incurred upon request.
21.4 Once a custom product has entered production, cancellation may no longer be possible because materials and labour have been committed specifically to that order.
21.5 Nothing in this section limits any cancellation rights afforded to consumers under the Consumer Protection Act or the Electronic Communications and Transactions Act where those laws apply.
22. RETURNS AND REFUNDS
22.1 Harveys Woodworx aims to provide products of exceptional quality. If you are not satisfied with your purchase, please contact us as soon as reasonably possible so that we may assist.
22.2 Returns and refunds are subject to the Consumer Protection Act 68 of 2008 (CPA) and our Refund & Returns Policy.
22.3 Customers may be entitled to a repair, replacement or refund where Goods are defective, unsafe, or fail to meet the standards required by the CPA.
22.4 Harveys Woodworx reserves the right to inspect any returned Goods before approving a refund, repair or replacement.
22.5 Refunds approved by Harveys Woodworx will be processed using the original payment method unless otherwise agreed.
22.6 The following are not regarded as defects:
- Natural variations in timber grain, colour or figure;
- Knots, mineral streaks or other natural characteristics of wood;
- Minor dimensional tolerances resulting from handcrafted manufacture;
- Slight seasonal movement of timber caused by humidity or temperature changes;
- Normal wear and tear;
- Damage caused by misuse, neglect, improper storage or incorrect maintenance.
22.7 Nothing in these Terms limits any rights that consumers have under the Consumer Protection Act.
23. WARRANTY
23.1 Consumers are entitled to the protections provided under Section 56 of the Consumer Protection Act where applicable.
23.2 In addition to any statutory rights, Harveys Woodworx may, at its discretion, offer voluntary warranties on selected products. Any such warranty will be communicated separately in writing.
23.3 The warranty does not cover damage resulting from:
- misuse;
- accidental damage;
- neglect;
- improper cleaning;
- prolonged exposure to water;
- dishwasher use;
- exposure to excessive heat;
- alterations made by persons other than Harveys Woodworx;
- failure to follow the Product Care Guide.
23.4 Nothing contained in this clause limits or excludes any rights that cannot legally be excluded under South African law.
24. PRODUCT CARE
24.1 Customers are responsible for maintaining timber products in accordance with the care instructions provided by Harveys Woodworx.
24.2 Failure to properly maintain timber products may reduce their lifespan and affect their appearance.
24.3 Harveys Woodworx recommends regular cleaning and maintenance using suitable food-safe oils or conditioners where appropriate.
24.4 Timber products should never be:
- soaked in water;
- washed in a dishwasher;
- placed in a microwave;
- exposed to excessive heat;
- stored while wet.
24.5 Harveys Woodworx is not responsible for damage resulting from improper care or maintenance.
25. INTELLECTUAL PROPERTY
25.1 Unless otherwise stated, all content on this Website is owned by or licensed to Harveys Woodworx.
This includes:
- photographs;
- logos;
- branding;
- product designs;
- graphics;
- text;
- videos;
- illustrations;
- downloadable content.
25.2 No content may be copied, reproduced, modified, distributed or used without the prior written permission of Harveys Woodworx.
25.3 Customers purchasing physical products do not acquire ownership of any intellectual property rights associated with those products.
26. USER CONTENT
26.1 Customers who submit photographs, reviews or other content grant Harveys Woodworx a non-exclusive, royalty-free licence to display such content for marketing and promotional purposes unless otherwise agreed.
26.2 Customers warrant that they own or have permission to use any content they submit.
26.3 Harveys Woodworx reserves the right to remove any content considered unlawful, offensive or misleading.
27. WEBSITE USE
27.1 You agree not to:
- interfere with the Website;
- attempt unauthorised access;
- upload malicious software;
- harvest customer information;
- use automated systems to scrape website content;
- impersonate another person or business;
- commit fraud through the Website.
27.2 Harveys Woodworx reserves the right to suspend access where misuse is suspected.
28. THIRD-PARTY SERVICES
28.1 The Website may make use of third-party services including payment processors, courier companies and Shopify.
28.2 Harveys Woodworx is not responsible for the independent policies, services or actions of third-party providers.
28.3 Customers are encouraged to review the policies of those third-party providers where applicable.
29. PRIVACY
29.1 Harveys Woodworx respects your privacy.
29.2 Personal information is collected, processed and stored in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).
29.3 Personal information may be collected for purposes including:
- processing orders;
- communicating with customers;
- arranging deliveries;
- responding to enquiries;
- improving our services;
- complying with legal obligations.
29.4 Harveys Woodworx does not sell customers' personal information.
30. LIMITATION OF LIABILITY
30.1 To the fullest extent permitted by South African law, Harveys Woodworx shall not be liable for indirect, incidental, special or consequential losses arising from the use of the Website or the purchase of Goods.
30.2 Harveys Woodworx shall not be liable for delays caused by circumstances beyond our reasonable control.
30.3 Customers acknowledge that timber is a natural material and that natural variations and seasonal movement are inherent characteristics of solid wood products.
30.4 Nothing contained in these Terms excludes liability where such exclusion is prohibited by South African law, including liability arising under the Consumer Protection Act.
31. INDEMNITY
31.1 You agree to indemnify and hold harmless Harveys Woodworx against claims, losses, damages, liabilities and expenses arising from:
- your misuse of the Website;
- your breach of these Terms;
- your violation of applicable law;
- your infringement of the rights of another person.
This clause does not apply where prohibited by law.
32. FORCE MAJEURE
32.1 Harveys Woodworx shall not be liable for delays or failure to perform obligations caused by events beyond our reasonable control.
These events include, but are not limited to:
- natural disasters;
- fire;
- flooding;
- pandemics;
- load shedding;
- supplier shortages;
- transport disruptions;
- strikes;
- civil unrest;
- government action;
- telecommunications failures.
32.2 Where reasonably possible, Harveys Woodworx will notify affected customers of any significant delays.
33. CHANGES TO THESE TERMS
33.1 Harveys Woodworx reserves the right to amend these Terms from time to time.
33.2 Updated Terms become effective upon publication on the Website unless otherwise stated.
33.3 Continued use of the Website constitutes acceptance of any revised Terms.
34. SEVERABILITY
34.1 If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be severed from the remainder of the Terms.
34.2 The remaining provisions shall continue in full force and effect.
35. WAIVER
35.1 Any failure by Harveys Woodworx to enforce a provision of these Terms shall not constitute a waiver of that provision or any other rights.
36. GOVERNING LAW
36.1 These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
36.2 Any dispute arising from these Terms shall be subject to the jurisdiction of the competent courts of South Africa.
36.3 Where applicable, consumers retain the right to approach the appropriate statutory bodies, including the National Consumer Commission or other competent dispute resolution forums, as provided by South African law.
37. ENTIRE AGREEMENT
37.1 These Terms, together with any policies specifically incorporated by reference, constitute the entire agreement between Harveys Woodworx and the customer regarding the use of the Website and the purchase of Goods.
37.2 If any conflict exists between these Terms and mandatory provisions of South African law, the applicable law shall prevail.
